India Availability vs Legal Status: Why They Are Not the Same
Short answer: "available in India" describes whether an app can be reached and used from India. "Legal status" describes how Indian law treats it. They are separate. Under the Promotion and Regulation of Online Gaming Act, 2025, in force since 1 May 2026, online money games are prohibited in India, so an app can be fully reachable from India and still fall under that prohibition.

What the 2025 Act Says
The Promotion and Regulation of Online Gaming Act, 2025 (Act No. 32 of 2025) defines an online money game as an online game, "irrespective of whether such game is based on skill, chance, or both", played by paying fees, depositing money, or other stakes in expectation of winning money or other enrichment. E-sports are excluded.
- Section 5 prohibits offering online money games and online money gaming services.
- Section 6 prohibits advertisements that directly or indirectly promote them.
- Section 7 bars banks and payment services from processing payments for them.
- Section 9 sets penalties: up to three years or up to ₹1 crore for offering them, up to two years or up to ₹50 lakh for advertising them, with higher minimum penalties for repeat offences.
- Section 14 allows access to online money gaming services to be blocked under Section 69A of the IT Act, 2000.
- Section 8 lets the government set up an Authority that can decide whether a particular game is an online money game.
The Act's penalties are aimed at those who offer, advertise, or process payments for online money games. The Online Gaming Rules, 2026 were notified on 22 April 2026, and both the Act and the Rules came into force on 1 May 2026 (Press Information Bureau).
Why "It's Available" Is Not "It's Allowed"
Many offshore apps remain reachable from India, because blocking takes time and domains change. Reachability shows only that enforcement has not reached a particular domain yet. It is not approval. The reverse is also true: an app that is hard to reach is not automatically illegal, since access problems can be technical.
A "skill game" label does not settle the question either. The Act's definition covers games based on skill, chance, or both, if money or other stakes are involved.

- State Restrictions need a dated, citable reference. Older state-by-state lists predate the national Act and are not treated as permission.
